Simple Explanation of EasySell Concept

EasySell is a bulletin board style service for classified advertisements and online shopping, just like an electronic newspaper. Classified Basic Ads are free. We will provide additional options for featuring your ad at a later stage. There is no further follow up or charges from EasySell. Just place your ad and respond to the buyers. You can set a price, or just accept bids for as long as you wish until expiry date of your ad. Your ad stays until sold or you remove it, or we remove it because you are in breach of our terms. The anniversary date is the same day, three months later of your placement.

It's EasySell!

EasySell classified advertising space is available to all persons acting as a private seller or to registered businesses for the purposes of advertising goods or services for sale.

EasySell may only be used by persons who are legally able to make contracts. If you are under 18 years old, please ensure you are able to enter into contracts or if you are in any doubt, ask your parents or guardians to use the services on your behalf.

We do not get involved in the transaction or the content of the advertisement, and all interaction (just like a newspaper) is carried out between the buyer and the seller. We do not review or screen content before listing, however, if inappropriate data is found we will remove it immediately without notice or refund.

Because we only store minimal data about you, for your protection, we cannot guarantee in any way the identity or the character of a person that places an advertisement or who contacts a seller about an advertisement. Similarly, we cannot endorse, guarantee or verify the accuracy or content of an advertisement.

All online trading requires care on the part of the seller and the buyer just like a newspaper.

As a minimum, with any online transaction, you should take simple precautions such as using:

  • COD
  • Paypal (Highly Recommended) or Similar secure Payment facilties
  • Credit cards
  • or other financial instruments that can be cancelled and traced and not placing money into an unknown person's bank account.

Caution should be exercised with advertisers accepting only Western Union or money orders, and any phone numbers listed by the seller should be verified by you, before sending any money to a seller.

Protect your identity by using email for initial contacts Do not disclose your personal details unnecessarily. Ask sellers for appropriate documents to prevent the purchase of stolen or illegally modified goods. You should always ask for a receipt and see proof of identity of the seller.

In essence you should act with at least the same caution, as if you are responding to a classified ad in a public newspaper. On the internet there are many honest people but you must also understand that the person who says they are next door may be thousands of miles away!

Please report any problems of dishonest trading, illegal activity, or offensive behaviour to us on badreport@EasySell.net.nz immediately, as we have a policy of blocking users that attempt to defraud, cheat or offend others and we reserve the right to remove inappropriate data at our absolute discretion without notice or refund.

Using EasySell

The following terms and conditions govern your use of EasySell's services. Please read these terms and conditions carefully. If you are willing to accept them then please acknowledge your acceptance by ticking the box wherever requested. If you do not accept these terms and conditions, you may not proceed to register your password.

EasySell is an online classified advertising bulletin board for people wishing to buy, sell or trade personal items and for registered businesses to host a web page or e-shop.

By using any of the services of EasySell you acknowledge and agree to the following:

  1. You are of an age where you can legally make contracts or are using EasySell in conjunction with your parents or guardians who will buy or sell on your behalf.
  2. This website is physically located in Queensland Australia and is intended to be read and used by Australian residents only. This website and the contents are not to be construed as any form of recommendation, promotion or endorsement by EasySell of any property, goods or services advertised on this site or the identity or character of any person represented on this website other than official EasySell website content.
  3. All advertising is subject to compliance with the laws of the relevant State or Territory of Australia and the Commonwealth of Australia. It is the advertiser's responsibility to ensure the advertiser is legally able to place the advertisement.
  4. All advertisements will be placed in the English language and be truly representative of the goods or services advertised. The advertisements and any photographs or drawings used must not be offensive and must not show things such as, but not limited to, frontal nudity or offensive symbols or remarks. Any advertisement that in our opinion breaches this condition will be removed by us immediately without notice or refund.
  5. ALL USERS AGREE THAT USING THE EasySell WEBSITE AND SERVICES IS ENTIRELY AT THE USER'S OWN RISK AND THE ADVERTISING SPACE IS PROVIDED ON AN 'AS IS' BASIS, WITH NO EXPRESS WARRANTIES AND, EXCEPT AS PROVIDED BY LAW, NO IMPLIED WARRANTIES. ADVERTISEMENTS ARE PLACED AT THE ADVERTISER'S RISK AND RESPONDED TO BY BUYERS OR SELLERS AT THEIR RISK. ALL LIABILITY FOR SELLING OR BUYING REMAINS WITH THE USERS
  6. Feedback or Comments given by registered users of EasySell are the sole responsibility, and soley the opinion, of the user who gives the feedback. EasySell is not liable for any consequences to anyone of such feedback. Should you believe you have been unfairly commented upon please contact EasySell Customer Services Team by clicking on the contact us tab, and EasySell staff will work with you to resolve the issue. Providers of feedback are under the same relevant terms and conditions as the normal users of EasySell website, and feedback deemed offensive or unacceptable under our terms may be removed at EasySell's discretion.
  7. By placing an advertisement on the EasySell website you agree to pay any fee required ( applies to online shopping ads, shopping centre banners and upgrades to classifed ads only, basic classified ads remain free) by valid credit card prior to your advertisement appearing on the EasySell website. Our fees include GST and are quoted in NZD. We do not refund fees under any circumstances. Payment for all chargeable EasySell services is by way of PayPal, Credit Card or Bank Transfer dependant upon transaction type. EasySell and our Payment Transaction Service Providers reserve the right to reject any payment that does not satisfy the normal credit card requirements for online trading.
  8. Any advertisement placed in the classified (including featured classified) sections will remain on the EasySell website for a period of at least 3 calendar months unless earlier removed by the advertiser, or by EasySell in the event of a breach of these conditions. Classified Ads may be automatically removed after 3 calendar months and may be relisted or placed by the advertiser again.
  9. All users are responsible for payment of relevant taxes or charges imposed by government authorities in relation to any sale and where applicable, prices must include GST. Advertisers must comply with all laws for the legal and proper transfer of title of any property, goods or services sold. All advertisers who conduct businesses and are required to have an Australian Business Number (ABN) must show that ABN on any advertisement they place on EasySell.
  10. All advertisers must be legally able to buy or sell the items they advertise on the EasySell website. EasySell reserves the right to immediately remove any advertisement without notice or refund if EasySell suspects the advertiser is not legally capable of making contract or may be engaged in any fraudulent activity. Any advertiser suspected of engaging in buying or selling stolen, pirated or illegally obtained items or engaging in any other fraudulent or illegal activity will be reported to relevant government authorities.
  11. The advertiser is responsible for the accuracy and integrity of all content of any advertisement on the EasySell website. EasySell DOES NOT IN ANY CASE WARRANT OR GUARANTEE, NOR CAN BE HELD RESPONSIBLE FOR USER LISTED CONTENT.
  12. All persons using the EasySell website are responsible for satisfying themselves to the identity and integrity of the person with whom they choose to communicate, trade, buy or sell.
  13. EasySell will not accept any liability for any unauthorised use of the EasySell website or for any breach of security, loss of data nor for interference to any data by any person who is not an authorised representative of EasySell.
  14. EasySell IS NOT AN AGENCY AND IS NOT INVOLVED IN ANY TRANSACTION BETWEEN BUYER AND SELLER, NOR DOES EasySell ACCEPT ANY RESPONSIBILITY FOR THE ACCURACY AND CONTENT OF ANY ADVERTISEMENT, OR FOR THE IDENTITY, INTEGRITY OR CHARACTER OF ANY PERSON SELLING, BUYING OR CONTACTING A USER OF THE EasySell WEBSITE. SELLERS AND BUYERS MUST BE AWARE OF ALL RISKS ASSOCIATED WITH BUYING OR SELLING ONLINE. THE NEGOTIATION AND TRANSACTION WITH ANY BUYER OR SELLER IS BETWEEN, AND SPECIFIC TO, THAT BUYER AND SELLER. THE TERMS OF TRADE, INCLUDING PRICE, THAT YOU AGREE DOES NOT INVOLVE EasySell AND WE ACCEPT NO RESPONSIBILITY FOR THE TRANSACTION, CONTRACT, OR NEGOTIATION. COMPLETING YOUR CONTRACT/SALE IS THE INDIVIDUAL RESPONSIBILITY OF EACH BUYER AND SELLER AND EASYSELL DOES NOT WARRANT OR GUARANTEE ANY PART OF ANY TRANSACTION. EasySell ACCEPTS NO RESPONSIBILITY OR LIABILITY FOR ANY COSTS, LOSS OR LIABILITY INCURRED BY ANY USER ARISING OUT OF OR OTHERWISE CONNECTED WITH ANY NEGOTIATION OR TRANSACTION ARISING FROM AN ADVERTISEMENT MADE ON EasySell.
  15. EasySell retains the right to terminate your use of the EasySell website for any breach of conditions, or for any content deemed offensive, or in contravention of any law. EasySell's decision in such judgement is considered final and NO REFUNDS will be made for any content removed, or any user terminated, under this clause.
  16. EasySell reserves and retains the right to delete or modify any content without notice, if EasySell believe that the information you provide is inaccurate, incorrect, misleading, illegal, offensive or pertaining to illegal or immoral activity or generally considered by EasySell to be in breach of acceptable use of the EasySell website.
  17. You must provide a valid and current email address, and contact details, to advertise on the EasySell website, and you may not misrepresent your identity, location or the location of the items listed. EasySell advises all registered users that we do capture a record of your IP address at point of registration and login. This is for the security and protection of all registered users, and is not used for any commercial purpose.
  18. You agree that you will not post content or make available in any format any content that in EasySell's opinion is:

    • false, inaccurate or misleading;
    • fraudulent or otherwise in breach of any law;
    • harmful, defamatory, offensive or threatening;
    • fake or false advertising;
    • obscene or contains content not suitable for publication on EasySell's website;
    • capable of disrupting, attacking or damaging EasySell's website;
    • liable to contain or does contain viruses of any kind or other computer programming routines that may interfere with the EasySell website or any content on that website;
    • capable of creating any liability for EasySell other than to show the advertisement;
    • capable of linking a user to any other website that includes descriptions of goods or services that are prohibited under these conditions; are identical to items you have advertised but are priced at a lower amount, or the content on that other website is capable of interfering with or damaging this website or EasySell's business.

  19. As a user of the EasySell website you hereby agree not to harass any person, and to only make contact with other users for the purpose of negotiating a sale for an item advertised on the EasySell website. You further agree not to send any unsolicited mail, data or content to EasySell users except for the initial contact in response to an advertisement or invitation to contact.
  20. EasySell is not responsible for any delays or errors caused by third parties. This includes, but is not limited to delays in transmission, website downtime, and any other technical issues that could be encountered. EasySell is not liable for any loss or damage caused by any delays.
  21. EasySell'S ENTIRE LIABILITY, INCLUDING LIABILITY FOR ANY WARRANTY OR CONDITION IMPLIED BY LAW TO AN ADVERTISER ON THE EasySell WEBSITE IS LIMITED, AT EASYSELL'S OPTION TO:

    • THE RE-ADVERTISING OF THE ADVERTISEMENT; OR
    • THE REFUND OF THE ADVERTISING FEE, IN RESPECT OF THE ADVERTISEMENT GIVING RISE TO THE LIABILITY.


  22. EASYSELL'S ENTIRE LIABILITY TO A BUYER USING THE EASYSELL WEBSITE UNDER ANY CIRCUMSTANCES IS LIMITED TO AN AGGREGATE OF $50 NZD
  23. EasySell is not liable to a user for loss profits, lost savings, loss of items advertised, loss of money paid for any items advertised, data corruption, damage resulting from loss of transmission, inability to use this website, transactions, property, goods or services available on this website or any other website or portal accessed to or from this website, or any indirect, consequential or special loss or damage incurred arising out of or connected with the use of this website.
  24. All content placed by EasySell on the EasySell website is protected by copyright and permission must be obtained in writing from EasySell or the relevant copyright owners to reproduce or copy any part of the content.

  26. EasySell allows, on approval and in good faith, the addition of links, banner advertisements and other forms of link/advertisements to third party websites, including links through the Google Ads system. EasySell accepts no responsibility whatsoever for the content, authenticity, integrity or actions of any of these linked sites or their associated businesses. Any complaint regarding a problem with a linked site may be advised to EasySell by email who will investigate and ascertain if the link breaches our conditions and should be removed. Any claim arising from any linking to any site must be made to the owner of the linked site.
